Terms of service

These terms govern use of the OptiSight Global website and platform provided by OptiSight Global. By creating an account, accepting an invitation to a workspace or submitting a pilot request, you agree to them on behalf of yourself and, where applicable, your organization.

1The service

OptiSight Global is a software portfolio decision intelligence platform. It reads the software usage, entitlement, contract, people and subscription data an organization imports and produces analyses, signals and recommendations about that data. The service is provided to organizations for their internal use in managing their own software estate.

The platform is provided as it is on the date you use it. Features described as planned on this website are not part of the service until they ship.

2Accounts and workspaces

You must provide a valid email address and keep your password confidential. You are responsible for activity under your account. A workspace belongs to the organization that created it; its owners and admins decide who is invited and may remove members at any time.

3Your data

You retain all rights in the data you import. You grant OptiSight Global the right to process it only to provide the service to you, as described in the privacy notice. You are responsible for having the right to import it, including any personal data about your organization’s staff, and for telling those people what you have done where the law requires it.

4What the analysis is, and is not

Figures in the platform are computed from your import by a stated method. Modelled estimates and recommendations are labelled as such where they appear, and each carries a confidence level. Estimates and recommendations are exactly that: they depend on the completeness and accuracy of the data you imported and on the assumptions you chose, and they are offered to inform your decision, not to make it.

OptiSight Global does not guarantee any saving, any negotiation outcome, or the fitness of a recommendation for a particular decision. Confidence levels shown in the platform describe the evidence behind a figure and are not a warranty.

5Acceptable use

You agree not to:

  • attempt to access data belonging to another organization;
  • probe, scan or test the vulnerability of the service other than by reporting a finding to the security address on the Security page;
  • import data you have no right to process;
  • resell the service or use it to build a competing product.

6Pilots and advisory services

A pilot is a time-limited use of the platform on your own data, scoped in writing between you and OptiSight Global before it starts. Advisory services, where offered, are described on the Services page and are provided under a separate written agreement. Nothing on this website is an offer that a submission accepts; a pilot or engagement begins when both sides have agreed to it.

7Availability and changes

OptiSight Global may change the service and these terms. Changes to these terms take effect when the date at the top changes; a change that materially reduces the service will be announced to account holders in advance. The service may be unavailable during maintenance or for reasons outside OptiSight Global’s control.

8Liability

To the fullest extent permitted by law, OptiSight Global’s total liability arising out of the service is limited to the amount you paid for it in the twelve months before the claim, andOptiSight Global is not liable for indirect or consequential loss, including a decision taken on the basis of an analysis. Nothing in these terms limits liability that cannot be limited by law.

9Termination

You may stop using the service at any time and ask for your workspace to be deleted. OptiSight Global may suspend or end access for a breach of these terms, and will say why where it is permitted to.
